If there is pending FIR u/s 498a IPC as against a NRI or any Indian husband has got a Canadian Offer or other abroad lucrative offer and he is planning to file for Passport and is worried about PCC then there is a good news for such NRI or prospective NRI as there are now some tips for getting/ applying PCC with FIR 498a pending because 498a FIR is NOT a criminal case.
Similarly, a Charge Sheet under section 498a of Indian Penal Code is also NOT a Criminal Case and therefore a husband can NOT be charged with hiding material information.
In Passport there is a column to disclose criminal records and criminal cases against the person who has been applying for the passport.

Remember that, there may come a problem in PCC only if your beloved chacha ji or some close relative informs the police, so do two things as follows:-
(a) do NOT disclose to any of your relatives that you are applying for Passport. and do NOT even inform any lawyer etc about this.
and
(b) if a problem comes then file Post-PCC LTR with the assistance of LTR
Note:- If you do NOT want to get into any trouble in PCC then INSTEAD of filing Post-PCC LTR after getting into trouble, it's advisable by aturchatur that u may file Pre-PCC LTR
Remember that, if the PCC is applied and obtained and then the husband gets his ticket to Canada/USA etc then the NRI husband or even Indian Husband can NOT be arrested at the airport even if there is an LOC against such NRi HUSBAND or Indian husband
Even if there is a PO Order against such 498a husband and even if it is assumed that the 498a was true or partially true, and despite proclaimed offender tag on the husband, even then, THIS HUSBAND CAN NOT BE ARRESTED at the airport even if the airport authorities comes to know about that LOC against the Matrimonial Dispute Basis Proclaimed Offender but to prevent any such arrest the husband HAS TO file a Pre-LTR i.e., a Pre-Travel LTR and he must inform the aturchatur team that he is going abroad and there is 498a FIR and that he wants protection from arrest at airport as the LOC/PO is issued against him or both LOC and PO are against him.
