A significant Delhi High Court judgment from 3 July 2026 dealt with exactly this kind of cross-border custody situation.
In KC v. State & Anr., 2026 LiveLaw (Del) 613, the father approached the Delhi High Court seeking custody and repatriation of his minor son to Canada.
According to the case record, the child had been brought to India from Canada in October 2019 without the father's consent.
The Canadian Superior Court of Justice, Ontario, had subsequently passed orders concerning the child's return and had granted the father temporary sole custody.
The child continued to remain in India for almost six years.
The mother argued that the child had become socially and emotionally settled in India and that sending him back to Canada would uproot him from his established environment.
The Delhi High Court examined that argument — but the Court also looked closely at something else:
क्या India में इतने वर्षों तक बच्चे का रहना उस continuing foreign court order को practically खत्म कर सकता है?
The Division Bench held that a parent cannot obtain a legal advantage merely by retaining a child contrary to a continuing foreign court order and then relying upon the passage of time to argue that the child has become settled.
The Court also noted that the mother had participated in the Canadian proceedings and could not simply disregard the foreign court's authority after an outcome that was adverse to her.
The High Court ultimately directed that the child be returned to the jurisdiction of the Canadian court within six weeks, with temporary custody to the father. The mother was also permitted to accompany the child to Canada, with suitable residential arrangements directed for her and the child.
If your child is living abroad and a custody order has already been passed there, “अब बच्चा India में है, इसलिए मामला automatically बदल गया” मान लेना dangerous assumption हो सकता है.
The chronology can become critical:
Foreign custody proceedings → consent/participation → foreign court order → child's movement to India → prolonged stay in India → Delhi proceedings.
और यही जगह है जहाँ documents, foreign court orders, travel records, custody arrangements, school records and previous proceedings suddenly become extremely important.
Every international custody case is fact-specific. The Court's decision in this case turned on the particular history of the Canadian proceedings, the continuing order and the circumstances recorded by the Bench.
For a Delhi/NCR NRI husband, therefore, a child-custody dispute should not be treated as merely a routine matrimonial disagreement.
