Delhi MenCell: Wife ने Divorce Case Delhi से बाहर Transfer करा दिया तो Husband क्या करे?
“Divorce case मैंने Delhi में file किया था… अब मुझे Bihar जाकर case लड़ना पड़ेगा?”
यह situation कई Delhi husbands, Delhi-NCR men और matrimonial litigation में involved men के लिए अचानक बहुत stressful हो सकती है।
और सबसे important बात — case transfer होना और husband का physically हर तारीख पर दूसरे State जाना, दोनों हमेशा एक ही बात नहीं हैं।
20 August 2026 को Supreme Court ने Rainy Aanand @ Rainy Jha v. Prashant Kumar Mishra, Transfer Petition (Civil) No.1648/2025 में इसी तरह की situation deal की।
Husband ने Delhi के Tis Hazari Family Courts में divorce petition file की थी। Wife ने Supreme Court में उसे Madhubani, Bihar transfer करने की मांग की।
Supreme Court ने transfer petition allow कर दी और Delhi में pending HMA divorce case को Principal Judge, Family Court, Madhubani, Bihar transfer करने का order दिया।
लेकिन husband के लिए एक important procedural relief भी दिया गया:
उसे Family Court proceedings में online appear करने की permission दी गई — except उन dates पर जब Court उसकी personal presence को mandatory माने।
यानी practical question सिर्फ यह नहीं है कि:
“Case कहाँ चलेगा?”
बल्कि यह भी है:
“Case transfer होने के बाद मेरी attendance कैसे manage होगी?”
यह distinction Delhi matrimonial case, Delhi husband, MenCell, Men Cell Delhi और Purush Aayog Delhi जैसे search terms से help लेने वाले men के लिए बहुत important है।
क्योंकि एक matrimonial case के साथ नौकरी, business, family responsibilities और दूसरे connected proceedings भी चल सकते हैं।

लेकिन दूसरी तरफ, online appearance कोई automatic right नहीं है। Supreme Court के इस case में permission specifically order में दी गई थी और personal presence जहाँ mandatory हो, वहाँ exception रखा गया।
इसलिए अगर आपका Delhi divorce case, Family Court matter या matrimonial proceeding transfer होने की स्थिति में है, तो केवल “case transfer हो गया” सुनकर panic करने की बजाय यह देखना जरूरी है कि order में appearance, VC/online participation और personal presence के बारे में क्या व्यवस्था है।
एक transfer order को casually handle करना बाद में attendance और procedural complications पैदा कर सकता है।
